Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the PantryAI mobile application ("App"), operated by Atom Digital Group Ltd, a company registered in Scotland (Company Number: SC866714) ("Company," "we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

2. Definitions

• "App" means the PantryAI mobile application available on iOS and Android platforms
• "User," "you," "your" means any individual who downloads, installs, or uses the App
• "Content" means all text, images, recipes, and other materials provided through the App
• "AI Services" means the artificial intelligence features including ingredient identification, recipe generation, and recipe image generation
• "Account" means the optional account you may create in the App using an email address and password, or by signing in with Apple or Google

3. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this requirement.

4. Description of Service

PantryAI provides:

• AI-powered ingredient identification from photographs
• Barcode scanning for quick product entry
• Digital pantry inventory management with estimated expiry and freshness tracking
• AI-generated recipe suggestions based on available ingredients
• AI-generated recipe images
• Recipe saving and organisation features
• An optional Account with cloud backup and multi-device sync

5. Subscription Plans and Pricing

5.1 Billing

• Subscriptions are billed monthly or annually, depending on the plan you choose, through Apple App Store or Google Play Store
• Payment is charged to your app store account upon confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

5.2 Cancellations and Refunds

You can cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of your current billing period, and you keep access to paid features until then.

Deleting your Account in the App does not cancel your subscription — cancel it in your app store settings as above. Payments and billing are handled by Apple or Google, so refund requests are subject to the relevant app store's refund policy. Nothing in these Terms limits or excludes any statutory rights or remedies you have under UK consumer law, including the Consumer Rights Act 2015 — for example, your rights where digital content is faulty, not as described, or not fit for purpose.

5.3 Usage Limits

• Monthly usage limits reset on the first day of each calendar month
• Scans, recipe searches, and recipe-image generations are each subject to their own monthly limit; unused allowances do not carry over to subsequent months
• Exceeding your plan's limits requires upgrading to a higher tier

6. User Obligations

You agree to:

• Provide accurate information when using the App
• Use the App only for lawful purposes
• Maintain the security of your device and, if you create an Account, of your sign-in details
• Not share, transfer, or sell access to your subscription

7. Accounts and Cloud Sync

7.1 Optional Registration

You do not need an Account to use the App's core features. You may create one using an email address and password, or by signing in with Apple or Google, to back up your data and use the App on more than one device. You must provide accurate registration information, keep your sign-in details confidential, and not share your Account with others. You are responsible for activity that takes place under your Account.

7.2 Cloud Backup and Sync

While you are signed in, your pantry items, saved recipes, staples list, and cooking history are backed up to our servers and synced to your other signed-in devices. Sync runs automatically from time to time and when you sign out. We may suspend or modify sync features where reasonably necessary, for example for maintenance or to protect the service.

7.3 Account Deletion

You can delete your Account and its data at any time, from inside the App: Settings → My Account → Delete Account & Data → "Delete permanently". You do not need to contact us first or give a reason. Deletion is immediate and cannot be undone: it removes your Account details, your pantry, saved recipes, staples, cooking history and cloud backup from our servers, signs out every device, and wipes the App's data on the device you delete from. The same option is available if you have never created an Account, and deletes the install record held for your device.

Two things deletion does not do. It does not cancel a paid subscription — cancel that through your App Store or Google Play account settings, or you will continue to be charged. And it does not remove the limited hashed abuse-prevention record described in section 13.3. Section 9 of our Privacy Policy sets out in full what is deleted, what is kept, and how to ask us to delete data if you cannot use the in-app option.

8. Intellectual Property

8.1 Our Rights

The App, including its design, code, branding, and original content, is owned by Atom Digital Group Ltd and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

8.2 Your Rights

You retain ownership of photographs you upload. By uploading photographs, you grant us a limited licence to process them for ingredient identification purposes only.

9. AI-Generated Content Disclaimer

IMPORTANT NOTICE REGARDING AI-GENERATED RECIPES:

• All recipes generated by the App are created by artificial intelligence
• We make NO guarantees regarding the accuracy, safety, nutritional value, or suitability of any recipe
• Recipes are provided for informational and entertainment purposes only
• You are solely responsible for verifying ingredient safety, cooking temperatures, preparation methods, and suitability for your dietary requirements
• We strongly advise consulting professional sources for food safety guidance
• We accept no liability for any illness, injury, allergic reaction, or adverse effect resulting from following AI-generated recipes

10. Expiry & Freshness Tracking Disclaimer

IMPORTANT NOTICE REGARDING EXPIRY DATES AND FRESHNESS TRACKING:

• Any expiry, "use by," or "best before" date the App shows or estimates is a best-guess estimate only, based on category averages or settings you choose — not on the actual product in your possession
• Expiry estimates and freshness tracking are provided for general guidance and convenience only, may be inaccurate, and can differ significantly from the real shelf life of your food
• You must always check the actual expiry, "use by," and "best before" dates printed on the physical product, and inspect food for signs of spoilage, before cooking or eating it
• You should never rely on the App's estimate or countdown to decide whether food is safe to consume; it is not a substitute for the manufacturer's labelling or your own judgement
• We accept no liability for any illness, injury, food poisoning, or other adverse effect resulting from consuming food that was past its actual expiry date, regardless of any time remaining or "fresh" status the App may have displayed

11. Limitation of Liability

11.1 Disclaimer of Warranties

We do our best to make PantryAI reliable and safe. That said, here's what we're legally required to tell you:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, data, or goodwill
• Our total liability for any claims arising from your use of the App shall not exceed the total amount paid by you for subscriptions in the twelve (12) months preceding the claim
• We shall not be liable for any harm resulting from the preparation or consumption of food based on AI-generated recipes
• We shall not be liable for any harm resulting from reliance on App-estimated expiry dates or freshness tracking, including food consumed after its actual expiry date

11.3 Statutory Rights and Non-Excludable Liability

Nothing in these Terms limits or excludes our liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation; or
• any other liability that cannot be limited or excluded under UK law, including your statutory rights and remedies as a consumer under the Consumer Rights Act 2015.

12. Indemnification

You agree to indemnify, defend, and hold harmless Atom Digital Group Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or breach of these Terms.

13. Termination

13.1 By You

You may stop using the App at any time. To end everything: cancel any active subscription through your App Store or Google Play settings, delete your data using Settings → My Account → Delete Account & Data (see section 7.3), and then uninstall the App. Uninstalling on its own removes only the copy on your device — it does not delete the data held on our servers.

13.2 By Us

We may suspend or terminate your access to the App or your Account:

• Immediately, where you breach these Terms or the Acceptable Use Policy, or where your conduct is harmful to other users or the App
• For any other reason, on giving you reasonable notice

Where we suspend or terminate a paid subscription other than for your breach or harmful conduct, we will give you reasonable prior notice or a pro-rata refund of the unexpired part of your current billing period.

13.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. No refunds will be issued for any remaining subscription period. If you delete your account, your personal account data is removed from our servers immediately; see our Privacy Policy for the limited hashed abuse-prevention record we retain for up to 180 days after deletion. That record contains only one-way hashes and cannot be turned back into your data, but while it lasts your previous usage counts carry over if you use the App again on the same device.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms within the App. Your continued use of the App following any changes constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Atom Digital Group Ltd regarding the App.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Scotland.

18. Data Protection and Privacy

We process personal data in accordance with our Privacy Policy, which forms part of these Terms and explains what we collect and why. Usage insights are collected automatically when you use the App; you can opt out in Settings → Data & Privacy. We also collect basic crash and error reports under our legitimate interests so that the App keeps working. You can delete your account and its data at any time from Settings → My Account → Delete Account & Data; section 9 of the Privacy Policy sets out exactly what that removes and what is retained. By using the App, you acknowledge that you have read the Privacy Policy.
